Welcome to RedTrack! These Terms of Service ("Terms") govern your access to and use of our GPS tracking service ("Service"). By registering for an account or using our Service, you agree to be bound by these Terms.
Important: Please read these Terms carefully. By using RedTrack, you agree to these Terms and our
Privacy Policy. If you do not agree, do not use our Service.
1. Acceptance of Terms
By creating an account, accessing, or using RedTrack, you affirm that you:
- Are at least 16 years of age
- Have the legal capacity to enter into binding contracts
- Will comply with these Terms and all applicable laws
- Have read and understood our Privacy Policy
2. Service Description
RedTrack provides a GPS tracking platform that allows you to:
- Track the real-time location of GPS-enabled devices
- View historical location data and routes
- Set up geofences and receive alerts
- Manage multiple devices from a single account
- Access tracking data through web and mobile interfaces
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
3. Account Registration and Security
3.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You must verify your email address
- One person or entity may only maintain one account
- You are responsible for maintaining the confidentiality of your password
3.2 Account Security
- You are responsible for all activities under your account
- Notify us immediately of any unauthorized access
- Use strong, unique passwords
- Do not share your account credentials
3.3 Account Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent activity
- Fail to pay subscription fees
- Use the Service for illegal purposes
4. Subscription and Payment
4.1 Free Trial
- New users receive a 30-day free trial
- No payment information required to start trial
- Full access to all features during trial period
- Trial automatically ends after 30 days unless you subscribe
4.2 Paid Subscription
- Pricing: £4.99 per device per month (billed monthly)
- Payment processed securely through Stripe
- Automatic billing on the same day each month
- Subscription starts when trial ends or when you manually subscribe
4.3 Billing and Renewal
- Subscriptions automatically renew monthly unless cancelled
- Your payment method will be charged on the renewal date
- Price changes will be communicated 30 days in advance
- Failed payments will result in a grace period before service suspension
4.4 Cancellation and Refunds
- You may cancel your subscription at any time
- Access continues until the end of your current billing period
- No refunds for partial months
- Refunds may be provided at our discretion for service issues
4.5 Device Pricing
- You are billed for each active device on your account
- Devices can be added or removed at any time
- New devices are prorated for the current billing period
- Removing devices reduces your next month's bill
5. Acceptable Use Policy
5.1 Permitted Uses
You may use RedTrack for lawful purposes, including:
- Tracking your own vehicles or assets
- Monitoring devices you own or have permission to track
- Fleet management for your business
- Personal safety and security
5.2 Prohibited Uses
You may NOT use RedTrack to:
- Track individuals without their knowledge or consent (stalking)
- Violate any person's privacy rights
- Engage in illegal surveillance
- Harass, threaten, or harm others
- Violate any local, state, national, or international laws
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to other accounts
- Use automated scripts or bots to access the Service
- Reverse engineer or decompile the Service
- Resell or redistribute the Service without permission
5.3 Legal Compliance
You are responsible for ensuring your use of GPS tracking complies with all applicable laws in your jurisdiction, including but not limited to:
- Privacy and data protection laws
- Employment and labor laws (for employee tracking)
- Vehicle tracking regulations
- Consent requirements
6. Data and Privacy
6.1 Your Data
- You retain ownership of all location data you generate
- We process your data as described in our Privacy Policy
- You can export your data at any time via our Data Export tool
- You can delete your account and all data permanently
6.2 Data Retention
- Location history: Last 365 days accessible in your account
- Older data may be archived or permanently deleted
- Upon account deletion, data is removed within 24 hours
- Billing records retained for 7 years per legal requirements
6.3 Consent for Tracking
Important: If you are tracking other individuals (employees, family members, etc.), you must:
- Obtain their explicit consent before tracking
- Inform them about the tracking and its purpose
- Comply with all applicable privacy laws
- Maintain documentation of consent
7. Intellectual Property
7.1 Our Rights
RedTrack and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute our software or content
- Use our trademarks without permission
- Remove any copyright or proprietary notices
7.2 Your License
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes in accordance with these Terms.
8. Service Availability and Support
8.1 Uptime
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- Planned maintenance will be announced in advance when possible
- Emergency maintenance may occur without notice

- Response time: Within 48 hours for non-urgent inquiries
- Priority support not currently available
9. Disclaimers and Limitations of Liability
9.1 Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Accuracy of GPS location data
- Reliability or availability
- Fitness for a particular purpose
- Non-infringement
9.2 GPS Accuracy
GPS location data may be affected by:
- Satellite visibility and atmospheric conditions
- Device quality and battery level
- Indoor/outdoor environment
- Network connectivity
We do not guarantee the accuracy, completeness, or timeliness of location data.
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Personal injury or property damage
- Claims arising from your use or inability to use the Service
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR £100, WHICHEVER IS GREATER.
9.4 Not for Emergency Use
Critical Safety Notice: RedTrack is NOT intended for emergency services or life-safety applications. Do not rely on the Service for:
- Emergency response or medical situations
- Preventing theft or criminal activity
- Child safety in place of proper supervision
- Navigation where failure could result in injury
Always contact appropriate emergency services (police, medical, fire) in urgent situations.
10. Indemnification
You agree to indemnify, defend, and hold harmless RedTrack and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your violation of any applicable laws
11. Modifications to Terms
We may modify these Terms at any time. When we do:
- We will post the updated Terms on this page
- We will update the "Last Updated" date
- We will notify you by email for material changes
- Continued use after changes constitutes acceptance
If you do not agree to the modified Terms, you must stop using the Service and cancel your account.
12. Dispute Resolution and Governing Law
12.1 Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
12.2 Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through:
- Informal Negotiation: Contact us at support@redtrack.uk to attempt resolution
- Mediation: If negotiation fails, disputes may be submitted to mediation
- Court Jurisdiction: Courts of England and Wales have exclusive jurisdiction
12.3 EU Consumer Rights
If you are an EU consumer, you retain all rights under EU consumer protection laws, including the right to pursue claims in your local jurisdiction.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RedTrack regarding the Service.
